Terms of Use

1. Right of Trade Mark

  • 1-1

    TEACHER7 (henceforth "this service") is the service which STH TECHNOLOGY PARTNERS (henceforth "STH") matches a linguistic teacher and a linguistic student. Languages here means every language including English. Teachers do not necessarily live in Japan. We find teachers from all over the world who best fit the student. "This service" is carried out including the site and e-mail service which support these matchings.

    TEACHER7 terms of service(this TOS)apply to all users including 'members' who have registered as members and 'nonmembers' who have not registered as members.

  • 1-3

    'Members' here means all the registered teachers and all the registered students and they are liable to comply with this TOS.

2. Membership

  • 2-1

    The users of this service are regarded to have used this service after having checked the contents of this TOS and consented.

  • 2-2

    The users of this service are regarded to have used this service after having checked the contents of this TOS and agreed.

  • 2-3

    STH can change this TOS of this service at any time. Members shall be notified of any changes in this TOS and the addition of any regulations through a homepage at any time, and members shall consent to this.

  • 2-4

    The conditions of member registration are as follows. When registered without fulfilling the conditions, member registration may be deleted by STH.

    • 2-4-1

      Register only as an individual. (Group, company or school can't register as an individual. Group registration needs consent of STH.)

    • 2-4-2

      Those who can reply to message or reservation request promptly.

    • 2-4-3

      Those who can correspond to members responsibly with sincerity.

    • 2-4-4

      Those who can pay with a credit card.

    • 2-4-5

      Those who register honestly.

  • 2-5

    When a problem occurs between a member and a third party owing to member registration, the member shall take full responsibility for finding a solution. And STH shall have no responsibility.

  • 2-6

    STH does not hold any responsibility for damage caused by a user breaking regulations.

  • 2-7

    When STH finds a service user breaking the regulations or registering false or malicious information, STH shall erase this member and prohibit the use of this service in the future years.

  • 2-8

    Members recieve ID and password (henceforth ID) at registration. The use of this ID is restricted only to the person himself. STH does not hold any responsibility for any damage caused by the transfer or loan of ID.

  • 2-9

    Members do not hold the right to claim investigation, damage, etc. when he suffers damage caused by the theft or lost of ID or the illegal use by a third party.

3. Transmission of information among members

  • 3-1

    Members can register their own profile from Mypage.This enables them to let students know the conditions they want. The authority to edit all registered information belongs to STH, which means STH can edit or delete without prior consent of the member.

  • 3-2

    Informational source which members transmit or register is restricted to what the member himself holds the copy right or other right to. When a photograph or the comment of a third person whose right is owned by a third person is posted, it is assumed the member has the consent from the person who holds portrait rights or copy right.

  • 3-3

    When a problem occurs among STH or other users, and a third party right holder, the violating member will solve this ata his own expense and responsibility with no responsibility from STH or other members.

  • 3-4

    Members shall be responsible for the contents of registration and posted information and shall not perform the following acts.

    • 3-4-1

      To post something that has nothing to do with this service.

    • 3-4-2

      To post contents aimed at obtaining profit, such as sale of goods, services, invitation etc. which are not related to the lesson.

    • 3-4-3

      To post incorrect contents or false contents.

    • 3-4-4

      To post repeated information intentionally.

    • 3-4-5

      To post inquiry or claim about this service.

  • 3-5

    Members are not to post information including the following matters.

    • 3-5-1

      The contents which infringe or possibly infringe on the copy right, right of trade mark, right of privacy, right of a name, portrait rights, and honor, or the rights of the third party.

    • 3-5-2

      Matters concerning privacy of others.

    • 3-5-3

      The information which can specify individuals, such as name, mail address, address, and telephone number.

    • 3-5-4

      Improper expressions such as defamation, slander, a complaint or a discriminatory remark against specific cooperation, an organization, an area, and an individual, (including posting in turned letters)

    • 3-5-5

      Porno novels or a photographs, invitation of sexual negotiation, other obscene contents

    • 3-5-6

      Nonsense and grotesque contents

    • 3-5-7

      Contents of a violent nature, barbarity, or crime involving a child or juvenile, preventing its healthy growth.

    • 3-5-8

      The contents which are or could be offensive to public order and morals or which break or could break the ordinance.

    • 3-5-9

      The information on sales or handing over of goods, discount coupons, cards of introduction.

    • 3-5-10

      Contents about advertisement, sales, election campaigns or inducement to certain thought or religion or the contents alike.

    • 3-5-11

      Contents which hint at introduction, recommendation of work, and a position, a place to study abroad, or introduction of a third party.

    • 3-5-12

      Contents which are or could be contrary to the theme and the purpose of this service.

    • 3-5-13

      Contents or expressions STH judges to be unsuitable in this service.

  • 3-6

    Members can't enter or transfer the information which can identify the individual in message function, lesson reservation, confirmation form

    STH can contain the functions of the member when STH judges unsuitable information has been transferred to other members in the message lesson reservation, reservation confirmation.

  • 3-8

    When a problem occurs among members and or among other users in message, lesson reservation or confirmation, the member shall solve this at his own expense and responsibility and STH shall have no responsibility.

  • 3-9

    Members are responsible for the information in member information in this service and STH shall have no responsibility.

  • 3-10

    Use of this service shall be performed at the responsibility of the member.

4. Service Charge

  • 4-1

    Only when introduction between a student and a teacher is approved, referral fee will be charged. Approval is completed when either a teacher or a student asks for the disclosure of the member information and the other approves it. Unless disclosure of member information is approved, there is no charge. On the student side, when reservation request to a teacher is approved, referral fee is charged. There is no charge when the reservation is not approved by the teacher. On the teachers' side, as long as teachers approve the reservation, there is no charge.

  • 4-2

    From the second time, there will be no charge in order to contact the member who has confirmed message confirmation and reservation confirmation. Members pay the referral fee by the credit card he has registered. If a problem occurs by the usage of an invalid credit card, the member shall solve the problem at his own expense and responsibility and STH shall have no responsibility.

  • 4-3

    If referral fee is not paid even after requested by STH, STH can erase his name from membership and refuse further use of this service.

  • 4-4

    When no lesson is given for any reason after both parties have approved and the referral fee is charged, no refund of referral fee is granted.

  • 4-5

    Refunds will be given at the discretion of the Company Management.

5. Prohibited Activity

  • 5-1

    Members shall not perform the following acts.

    • 5-1-1

      Registering false information.

    • 5-1-2

      Activities which infringe or possibly infringe on the copy right, right of trade mark, right of privacy or right of a name, portrait rights, and honor, or the right of the third party.

    • 5-1-3

      Activities such as defamation, slander, a complaint or a discriminatory remark against a specific cooperation, an organization, an area, and an individual.

    • 5-1-4

      Activities which cause damage to other users physically, mentally or economically.

    • 5-1-5

      Activities which can cause a criminal or illegal act.

    • 5-1-6

      Activities which are or could be offensive to public order and morals or which break or could break the ordinance.

    • 5-1-7

      Sales or soliciting of goods in the name of educational materials.

    • 5-1-8

      Sales or soliciting of goods or service of a specific company.

    • 5-1-9

      Sales or soliciting of certain financial commodities or investment methods.

    • 5-1-10

      Soliciting of debt or clearing debt.

    • 5-1-11

      Sales or inducement of marriage partner introduction service or dating service.

    • 5-1-12

      Sales or inducement of service or goods which are not necessary for the lesson.

    • 5-1-13

      Activities about advertisement, sales, election campaigns or inducement to certain thought or religion or the contents alike.

    • 5-1-14

      Inducement to network business, chain referral, or to pyramid sales. Activities of information service for profit using this service.

    • 5-1-15

      Activities to make use of the personal information you obtain through this service for any purpose other than this service.

    • 5-1-16

      Having others use this service by loaning or transferring your ID.

    • 5-1-17

      Activities which do or hint at introductions or a recommendation of work or position, a place to study abroad, or introduction of a third party.

    • 5-1-18

      Activities to hinder the management of this service or to impair credibility of STH.

6. Cease of Operation and Withdrawal

  • 6-1

    Members can cease the use of this service by using the withdrawal function when he wants to withdraw. However if message of reservation with other members is not completed, withdrawal will be approved after the completion.

  • 6-2

    After withdrawal, all the information the member posted is deleted.

  • 6-3

    When a member breaks regulation, STH can force him to withdraw. The member who was forced to withdraw can not use this service in future years.

7. Cease of operation and the responsibility of STH

  • 7-1

    STH may cease to provide this service temporarily without prior notice and consent.

    • 7-1-1

      Maintenance or change of system

    • 7-1-2

      When a natural disaster and other emergencies occur, or when there is a possibility of these and management of this service is difficult

    • 7-1-3

      In addition, when STH judges it to be unavoidable.

  • 7-2

    The contents and the service or URL are subject to change or be eliminated without notice

  • 7-3

    By violation of a member, when expense occurs in STH, or when payments, such as compensation are made, the member shall pay all expenses, and compensation (the legal fee which our company paid is included), etc. concerned.

  • 7-4

    STH shall not take any responsibility for the problem which is caused by inevitability. Inevitability means the following.

    • 7-4-1

      Disconnection, delay or halt caused by computer failure or telecommunication line.

    • 7-4-2

      Damage caused by virus.

    • 7-4-3

      Damage caused by alteration on site by a third party.

    • 7-4-4

      Damage caused by illegal access to the data of this service

8. Governing Law and Jurisdiction

  • 8-1

    Interpretation and application of this service and this agreement shall be determined in accordance with the laws of Japan.

  • 8-2

    Concerning all lawsuits in connection with this service, Tokyo District Court shall be the agreed jurisdictional court of the first trial.
